1. Acceptance of Terms

These Terms and Conditions of Use ("Terms") govern the access to and use of the Klike mobile application ("App", "Service"), developed and operated by Francesco Granata ("Klike", "we", "us", "our"), with registered office in Sellia Marina (CZ), Calabria, Italy.

By reading and accepting these Terms at the time of registration, you enter into a binding agreement with Klike. If you do not fully accept these Terms, you are not authorised to use the Service.

Klike reserves the right to modify these Terms at any time. Changes will be communicated via notification in the App or by email. Your continued use of the Service after such notification constitutes acceptance of the updated Terms.

2. The Klike Service

Klike is a social-game mobile application available on iOS and Android. The Service operates on the following mechanism:

Each day, a common photography theme is published for all registered users.
Users may take and upload a photo inspired by the theme of the day, which will be displayed in a public feed visible to all registered users.
The community may rate photos with a score from 1 to 5 stars.
At the end of each day, a leaderboard is generated with a daily winner.
At 00:00 (midnight), the feed and leaderboard reset automatically and the following day begins with a new theme.

Klike reserves the right to modify, suspend or discontinue any feature of the Service at any time, with or without notice.

3. Access Requirements and Registration

3.1 Age Requirements

To use Klike, you must be at least 14 (fourteen) years of age. By registering, you declare and warrant that you meet this requirement. Use of the App by minors under the age of 14 is expressly prohibited. In compliance with the GDPR, we do not knowingly collect personal data from minors under the age of 14.

3.2 Mandatory Registration

Use of Klike requires the creation of a personal account. To register, you may:

Enter your name, email address and a password; or
Use the Single Sign-On service via your Apple account (Sign in with Apple) or Google account (Google Sign-In).

3.3 Account Responsibility

You are solely responsible for maintaining the confidentiality of your login credentials. You are responsible for all activities carried out through your account. You are required to notify us immediately of any unauthorised access to your account at support@klikeapp.com. Klike is not liable for any damages arising from your failure to protect your credentials.

3.4 Accuracy of Information

At the time of registration, you undertake to provide accurate, complete and up-to-date information. The creation of false or multiple accounts intended to circumvent a ban or to manipulate the Service is expressly prohibited.

4. User Generated Content (UGC)

4.1 Definition

"User Generated Content" (UGC) refers to any material uploaded, shared or published by the user through Klike, including photographs uploaded in response to the daily theme.

4.2 Content Rules — MANDATORY

By uploading content to Klike, you declare and warrant that the material you publish complies with the following non-negotiable rules. It is strictly prohibited to upload, share or promote:

Illegal content of any nature, including content that violates applicable local, national or international laws.
Obscene, pornographic or sexually explicit content (NSFW — Not Safe For Work), including nudity, sexual acts or any other sexually suggestive material.
Content involving minors in any inappropriate or sexualised context. Such a violation will result in immediate reporting to the competent authorities.
Violent content or content inciting violence, including gore imagery, self-harm, or content that glorifies or promotes violent acts against persons or animals.
Discriminatory, hate-based or defamatory content based on race, ethnicity, nationality, religion, gender, gender identity, sexual orientation, disability or any other protected characteristic.
Bullying, harassment and stalking directed at other users or any other person.
Spam, unauthorised advertising content or any unsolicited mass communication.
Content that infringes third-party rights, including copyright, trademark rights, patents, trade secrets or the privacy and personality rights of others.
Deceptive, misleading or fraudulent content, including false representations of reality, non-consensual deepfakes or disinformation.
Malware, viruses or any malicious code harmful to third-party systems.
Content that exposes private information of others without consent (doxing).

Klike reserves the right to determine at its sole discretion whether content violates these rules.

4.3 Content Licence

Users retain full ownership of the photographs they upload to Klike. However, by uploading a photo to the App, you grant Klike a non-exclusive, royalty-free, worldwide licence, for the duration of your participation in the Service, to display, reproduce and distribute your photo within the Klike platform and its game features (public feed, daily leaderboard). Such licence is limited solely to the purposes of providing the Service and shall terminate upon deletion of the content or account, except to the extent necessary to fulfil any residual technical or legal obligations.

Klike will not use your photos for advertising purposes, third-party marketing or any purpose outside the Service without your explicit consent.

5. Zero Tolerance Policy and Content Moderation

5.1 Zero Tolerance

Klike applies a zero tolerance policy towards abusive behaviour, unlawful content or violations of these rules. We reserve the unquestionable right to:

Remove any content that violates these Terms or that we deem inappropriate, without any obligation to give prior notice or justification.
Suspend or permanently ban the account of the user responsible for the violation, without prior notice and without any right to reimbursement or compensation of any kind.
Report to the competent authorities any potentially unlawful content, in particular content involving minors.

5.2 Reporting and User Blocking Tools

To ensure a safe and respectful environment, we provide users with the following tools:

Report content: any user may report photos or conduct they believe to be in violation of these rules via the "Report" function available in the App. All reports are reviewed by our team.
Block user: any user may block other users to prevent any unwanted interaction.

We encourage you to use these tools to help maintain a safe and respectful Klike community.

5.3 Disclaimer of Liability for User Content

Klike is not responsible for content published by users. Although we are committed to monitoring and moderating content, we cannot guarantee prior review of all material published on the platform. Responsibility for uploaded content rests exclusively with the user who published it.

6. Klike's Intellectual Property

All intellectual property rights relating to the Klike App — including, by way of example, the source code, design, logos, trademarks, daily themes created by Klike, text and any other original elements — are the exclusive property of Francesco Granata or its licensors.

Your use of the Service does not grant you any intellectual property rights over the App or its content. Copying, modifying, distributing, selling or sublicensing any part of Klike without our express written consent is prohibited.

7. Monetisation and Purchases

The Klike App is currently completely free of charge. No in-app purchases, paid subscriptions or paid premium features are available. Should any monetisation model be introduced in the future, users will be informed with reasonable advance notice and through an update to these Terms.

8. Limitation of Liability

8.1 No Guarantee of Service Continuity

Klike provides the Service "as is" and "as available". We do not guarantee 100% continuous operation of the Service. The Service may be temporarily interrupted for maintenance, technical updates, force majeure events or other circumstances beyond our reasonable control. We shall not be liable for any disruptions, outages or malfunctions of the Service.

8.2 Disclaimer of Liability for User Actions

Klike disclaims any liability for the actions, conduct or content published by users. Each user is personally and directly responsible for their own actions and the content they publish through the App, including any legal consequences arising from such actions.

8.3 General Limitation

As the Application is provided entirely free of charge, Klike disclaims all liability for any damages, to the maximum extent permitted by applicable law.

Nothing in this clause limits the non-waivable rights granted to consumers under applicable legislation.

9. Governing Law and Jurisdiction

These Terms are governed by Italian law. Any dispute relating to the interpretation, validity or performance of these Terms shall fall within the jurisdiction of the Court of Catanzaro, except where applicable law provides for a different mandatory jurisdiction (e.g. the consumer's court of domicile).

10. General Provisions

Severability: If any clause of these Terms is found to be invalid or unenforceable, the remaining clauses shall remain in full force and effect.
Waiver: The failure by Klike to enforce any clause of these Terms shall not constitute a waiver of the right to enforce it in the future.
Entire Agreement: These Terms, together with Klike's Privacy Policy, constitute the entire agreement between you and Klike in relation to your use of the Service.
